These Terms of Use (the “Terms”) govern your access to and use of the website listed above (the “Site”), operated by SIG Denver LLC (“Wild Birds Unlimited,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Site. By using the Site, you represent and warrant that you meet this requirement and that any information you provide is accurate.

2. Acceptable Use

3. Online Ordering

Online purchases are processed through our partner platform at order.wbu.com. The terms, return policy, shipping policy, and refund policy of that platform apply to all online orders. Prices, availability, and product specifications may change without notice.

We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability. If we cancel your order after payment, we will issue a full refund.

4. Daily Savings Club & Loyalty Program

If you join the Daily Savings Club (DSC) or any other loyalty program we offer, you agree to the program rules in effect at the time. Memberships, points, and rewards have no cash value, are non-transferable, and may be modified or discontinued. We may suspend or terminate any membership for fraud, abuse, or violation of these Terms.

5. Intellectual Property

All content on this Site — including text, photographs, graphics, logos, designs, and the Wild Birds Unlimited® name and marks — is the property of SIG Denver LLC, our licensors, or our affiliates, and is protected by copyright, trademark, and other intellectual property laws. The Wild Birds Unlimited® name and trademarks are the property of Wild Birds Unlimited, Inc. and used under license.

Customer-submitted photos remain the property of the original photographer and are used with permission. By submitting photos or other content to us, you grant SIG Denver LLC a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with our business.

6. Third-Party Links and Services

Our Site may link to or integrate with third-party services (e.g., Google Maps, social media platforms, payment processors, shipping carriers). We do not control these services and are not responsible for their content, terms, or privacy practices. Your use of any third-party service is at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIG DENVER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
